			<content:encoded><![CDATA[<p style="text-align: justify;"><strong><em><span style="text-decoration: underline;">A</span></em></strong> tale has it that Dauis was once called &#8220;Mariveles&#8221;, based on a story of the statue or image of Our Lady of the Assumption, the town’s patroness who was said to have requested an unnamed fisherman to take her to this island called “Mariveles”. When they neared the coast, the lady said, “duol na ang Mariveles” (We are nearing Mariveles).</p>
<p style="text-align: justify;">
<p style="text-align: justify;">She got off the boat and went toward the beach where the palms now abound in Poblacion, Dauis. The fisherman revealed that the lady passenger disappeared and in her place saw an object, the image of which evoked the likeness of his passenger. It has been said that the name of the place is derived from the word “Lawis” which means a “sand bar”. It may also come from the word “dawi” which means “a fish biting the bait of a fishing hook and line.”</p>
<p style="text-align: justify;">
<p style="text-align: justify;">Recorded history of Dauis began with the arrival of two Jesuit priests, Fr. Diego de Ayala and Fr. Joseph Gragorio. Since then, there was a succession of Jesuit missionaries until 1786, and were later replaced by the Augustinian Recollect fathers until 1888. Since then, Filipino priests have taken over.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">The 18th century Dauis Church, dedicated to the “La Señora de la Asuncion” or Our Lady of the Assumption underwent so many changes starting from its inception when the first Spanish missionaries arrived in the town in 1697. The church was believed to be built of light materials.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">Bishop Juan Gorordo of Cebu consecrated the church on August 23, 1923. 61 years after Fr. Saldana laid its cornerstone, a cross was installed over the pediment in the year 1924. The convent constructed in 1884 was eventually renovated and utilized as Formation and Day Care Centers.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">The church of Our Lady of the Assumption is a center for Marian pilgrimages emanating from the different towns of Bohol. On certain occasions, the Tagbilaran faithful hike the distance from their city to the site to invoke special petitions or mainly to honor Our Lady of the Assumption.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">A well, known for its water’s healing power, lies at the foot of the main altar. Local history tells that this well originated from the Spanish era. Pirates often attacked Christian settlements and it was during one such attack that the people took refuge behind locked doors of the church. Besieged by the enemy for days, the people run out of food and water. The well miraculously sprang up and since then has become the source of drinking water for the populace nearby, especially during droughts. The water tastes truly fresh, despite the well’s closeness to the seashore.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">The image of the patron saint, Our Lady of the Assumption, is famed to be miraculous, too. (So many petitions of her devotees are granted!) Tales from time to time crop up that the patron saint’s attire is filled with amorsico, a vexing weed. The faithful believe that their Mother goes around Her domain as she watches over Her children. Dauis church is a pilgrimage site, with the pilgrims carrying empty containers to take home water from the miraculous well.</p>
<p style="text-align: justify;">
<p style="text-align: justify;">In 2004, the Parish of Our Lady of the Assumption was declared a Shrine honoring the patroness not only of Dauis but also for the whole province of  Bohol.</p>

			<content:encoded><![CDATA[<p>AUTHORIZED EXPENDITURES</p>
<p>SECTION 7.  USE OF APPROPRIATED FUNDS</p>
<p>	The amount release shall be disbursed solely for such items of expenditures as appropriated.</p>
<p>SECTION 8.  RESTRICTION ON THE USE OF GOVERNMENT FUNDS</p>
<p>	NO government funds shall be utilized for the following:</p>
<p>11.1	   To provide fuel, parts, repair and maintenance to any government vehicle not owned by the municipality, nor otherwise properly identified as a government vehicle.</p>
<p>All government vehicles shall be made available during transport crisis occasioned by floods, typhoons, and other emergencies to transport for free all commuters on a round-the-clock basis.</p>
<p>11.2  To pay honoraria, allowances or other forms of compensation to any government official or employee, except those specifically authorized by law;</p>
<p>11.3  To be invested in non-government securities, money market, placements and other similar investments or deposited in private banking institutions;</p>
<p>11.4   Claim for actual traveling expenses incurred within the territorial jurisdiction of the Municipality of Dauis shall not exceed PhP 400 per month for regular employees.</p>
<p>SECTION 9.  EXPENDITURE COMPONENTS.  Except by act of the Sangguniang Bayan, no change or modification shall be made in the expenditure items authorized in this Appropriation Ordinance (AO) unless in cases of augmentations from savings in appropriations as authorized under Section 336 of the Local Government Code of 1991 and Article 454 of the Rules and Regulations Implementing the Local Government Code of 1991.</p>
<p>SECTION 10.  USE OF SAVINGS.  The Local Chief Executive and the Presiding Officer of the Sangguniang Bayan are hereby authorized to augment any items in this budget document for their respective offices from savings in other items within the same expense class of their respective appropriations.</p>
<p>SECTION 11.  MEANING OF SAVINGS AND AUGMENTATIONS.  Savings refers to portions or balances of any programmed appropriations free from any obligation or encumbrances still available after the satisfactory completion or unavoidable discontinuance or abandonment of the work, activity or purpose for which the appropriation is authorized, or arising from unpaid compensation and related costs pertaining to vacant positions and leave of absences without pay. Augmentation implies the existence in this document of an item, project, activity or purpose with an appropriation, which upon implementation or subsequent evaluation of needed resources is determined to be insufficient. In no case, therefore, a non-existent item, project, activity, purpose or object of expenditure is funded by augmentation from savings or by the use of appropriations authorized otherwise in this document.</p>
<p>SECTION 12.  PURCHASE OF SUPPLIES, MATERIALS, EQUIPMENT AND EQUIPMENT SPAREPARTS.  The purchase of supplies, materials, equipment, and equipment spare parts shall be in accordance with Republic Act No. 9184.</p>
<p>SECTION 13.   EXTRAORDINARY AND MISCELLANEOUS EXPENSES.  For purposes of this Section, miscellaneous expenses shall include, but not limited to, expenses incurred for:</p>
<p>a.	Meetings, seminars and conferences<br />
b.	Official representation and entertainment<br />
c.	Public relations<br />
d.	Educational, athletic, and cultural activities<br />
e.	Contributions to civic and charitable institutions<br />
f.	Membership in government associations<br />
g.	Membership in national professional organizations duly accredited by the Professional Regulation Commission<br />
h.	Membership in the Integrated Bar of the Philippines<br />
i.	Subscription to professional technical journals and informative magazines, library books and materials<br />
j.	Office equipment and supplies<br />
k.	Other similar expenses not supported by regular budget allocation</p>
<p>	No portion of the amounts authorized herein shall be used for salaries, wages, allowances, intelligence, and confidential expenses. These expenditures shall be subject to pertinent accounting rules and regulations.</p>
<p>SECTION 14.  RELEASE OF FUNDS.  Any provision of law to the contrary withstanding, the appropriations authorized shall be released in accordance to prevailing issuances subject to availability of funds and economy measure implemented.</p>
<p>SECTION 15. DISBURSEMENT OF FUNDS.  All appropriated funds shall be disbursed only through originally chartered government-owned or controlled banks.</p>
<p>          	PERSONAL SERVICES BENEFITS</p>
<p>SECTION 16.  REPRESENTATION AND TRANSPORTATION ALLOWANCE (RATA).  The Municipal Mayor, Municipal Vice-Mayor, Sangguniang Bayan Members, Department Heads are hereby granted monthly commutable representation allowance and transportation allowance payable from the programmed appropriations provided in their respective office at the rate allowed by law or by pertinent issuances that may be issued in calendar year 2010.</p>
<p>	The transportation allowance herein authorized shall not be granted to officials who are assigned a government motor vehicle.</p>
<p>SECTION 17.  ENTITLEMENT TO THE PERSONNEL ECONOMIC RELIEF ALLOWANCE (PERA).  The PERA shall be granted to all appointive government personnel subject to the provisions of Budget Circular No. 2009-3 dated August 18, 2009 and pertinent issuance that may be issued in calendar year 2010.</p>
<p>SECTION 18.  UNIFORM OR CLOTHING ALLOWANCE.  The appropriations herein provided for each office may be used for the uniform and clothing allowance at not more than the authorized amount per regular employee per annum for calendar year 2010.</p>
<p>SECTION 19.  FOR THE PAYMENT OF MISCELLANEOUS PERSONNEL BENEFITS.  Payment of terminal leave, productivity bonus, maternity, paternity leave benefits, monetization of leave credits, social security benefits and other claims for all municipal government officials and employees will be as authorized by the Municipal Mayor. </p>
<p>		The amount appropriated shall be subject to implementing guidelines/circulars issued by the Department of Budget and Management (DBM).</p>
<p>		No amount shall be released and disbursed for miscellaneous benefits without the approval of the Municipal Mayor.</p>
<p>             ADMINISTRATIVE PROCEDURES</p>
<p>SECTION 20.  PHYSICAL PERFORMANCE TARGETS.  All departments, offices shall submit their respective physical performance targets approved by the Municipal Mayor as basis for the release of allotments.</p>
<p>SECTION 21.  ADVICE OF ALLOTMENT.  Expenditures as authorized in this document shall not be disbursed without the covering advice of allotment approved by the Municipal Mayor.</p>
<p>SECTION 22.  APPROPRIATION RESERVE.  The Local Chief Executive is hereby authorized to implement reserves.</p>
<p>SECTION 23.  BUDGET EXECUTION.  Execution of this budget shall be the responsibility of the Municipal Mayor and Municipal Vice  Mayor pertaining to and under their respective offices and shall comply with the Local Government Code of 1991 and related issuances.</p>
<p>SECTION 24.  GENERAL LIABILITY FOR UNLAWFUL EXPENDITURES.  Expenditures of funds or use of property in violation of this document shall be a personal liability of the employee responsible thereof.</p>
<p>SECTION 25.  SEPARABILITY CLAUSE.  In case any section, clause or sentence or paragraph or part of this document for any reason is adjudged by any court of competent jurisdiction to be invalid shall not affect, impair or invalidate the remainder of this document.</p>

<p>SECTION 3.  DONATIONS</p>
<p>	Departments and offices are authorized to accept donations, contributions, grants, requests, or gifts, or in kind from any foreign government, international and local agencies, private entities or individuals for the purpose relevant to their functions. Such receipts shall be accounted for in the books of the government and shall be subject to pertinent accounting and auditing rules and regulations. Such donations, whether in cash or in kind shall be deemed automatically appropriated for the purpose specified by the donor.</p>
<p>SECTION 4.  INSURANCE AND REGISTRATION OF GOVERNMENT VEHICLES</p>
<p>	The amount herein appropriated shall be used solely for the insurance and registration of government vehicles. Augmentation or transfer to other accounts of this fund shall only be allowed on the last quarter of the year.</p>
<p>SECTION 5.  PERFORMANCE BONDS AND DEPOSITS</p>
<p>	Performance bonds and deposits given or posted by private persons or entities shall be deposited with an authorized government depository bank as trust liabilities and under the name of the Municipality of Dauis, Bohol. Upon faithful performance of the undertaking or termination of the obligations for which the bond or deposit was required, any amount due shall be returned to the filing party or office concerned, and withdrawn in accordance with accounting and auditing rules and regulations:</p>
<p>	PROVIDED, that any interest accruing on deposit accounts and any forfeited amounts shall be recorded as income of the General Fund. This provision shall apply to bonds posted in cash, such as bidders bond.</p>
<p>SECTION 6.  INTELLIGENCE/CONFIDENTIAL FUNDS</p>
<p>	For payment of on-going security, intelligence and other related activities for the whole intelligence network operation. This fund may be used to purchase information related to illegal drugs activities, terrorism, and insurgency, payment of awards, rewards and incentives to informers, monitoring activities, safe-houses, and other related activities.</p>
<p>	The amount appropriated herein shall be used solely for the confidential and intelligence fund of the Municipal Mayor.</p>
